UMOWA

między Ministrem Sportu i Turystyki Rzeczypospolitej Polskiej a Narodową Komisją Kultury Fizycznej i Sportu Meksykańskich Stanów Zjednoczonych o współpracy w dziedzinie sportu, podpisana w Meksyku dnia 24 kwietnia 2017 r.

Minister Sportu i Turystyki Rzeczypospolitej Polskiej oraz Narodowa Komisja Kultury Fizycznej i Sportu Meksykańskich Stanów Zjednoczonych, zwane dalej „Stronami”,

BIORĄC POD UWAGĘ dotychczasową tradycję przyjacielskich stosunków między Stronami oraz dążąc do ich dalszego rozwoju i promowania,

PRAGNĄC rozwijać wzajemnie korzystną współpracę Stron w dziedzinie sportu,

DOCENIAJĄC rolę, jaką sport odgrywa w procesie rozwoju i umacniania przyjaznych relacji między obu państwami,

PRAGNĄC współpracować w ramach organizacji międzynarodowych, których są członkami, w dziedzinach objętych niniejszą umową,

MAJĄC NA UWADZE postanowienia umowy o współpracy w dziedzinie edukacji i kultury między Rządem Rzeczypospolitej Polskiej a Rządem Meksykańskich Stanów Zjednoczonych, zawartej w Warszawie dnia 12 czerwca 1997 r.,

uzgodniły, co następuje:

Artykuł 1 CELE OGÓLNE

1.    Strony na zasadzie wzajemności będą wspierały i umacniały współpracę oraz wymianę doświadczeń w dziedzinie sportu.

2.    Strony będą tworzyły warunki do bezpośredniej współpracy instytucji rządowych i pozarządowych oraz osób prawnych i fizycznych w celu realizacji niniejszej umowy.

3.    Strony będą wspierały podejmowanie dwustronnych inicjatyw polsko--meksykańskich w dziedzinie sportu, służących osiąganiu celów niniejszej umowy.

4.    Współpraca w ramach niniejszej umowy będzie prowadzona zgodnie z prawem obowiązującym w Rzeczypospolitej Polskiej i Meksykańskich Stanach Zjednoczonych.

Artykuł 2

OBSZARY WSPÓŁPRACY

Strony dla osiągnięcia celów niniejszej umowy będą realizowały współpracę w następujących obszarach:

1)    kształcenia i doskonalenia zawodowego w sporcie;

2)    sportu wyczynowego i młodzieżowego;

3)    sportu dla wszystkich;

4)    infrastruktury sportowej;

5)    informacji i dokumentacji sportowej;

6)    medycyny sportowej i walki z dopingiem;

7)    zarządzania w sporcie;

8)    sportu osób niepełnosprawnych i polityki równych szans przez sport;

9) promowania Rzeczypospolitej Polskiej i Meksykańskich Stanów Zjednoczonych poprzez sport;

10)    organizacji dużych imprez sportowych;

11)    rozwoju nauk o kulturze fizycznej i sporcie; oraz

12)    w każdym innym obszarze uzupełniającym cele niniejszej umowy, w którym Strony uznają współpracę za obopólnie korzystną.

Artykuł 3

FORMY WSPÓŁPRACY

Współpraca w obszarach, o których mowa w artykule 2, będzie realizowana w szczególności poprzez:

1)    wspieranie udziału sportowców, trenerów sportowych oraz personelu technicznego w zawodach sportowych organizowanych na terytorium Rzeczypospolitej Polskiej i Meksykańskich Stanów Zjednoczonych;

2)    koordynowanie programów wymiany sportowej, o których mowa w artykule 4;

3)    wymianę między Stronami informacji, o których mowa w artykule 6, a także wspieranie takiej wymiany między działającymi na terytorium Rzeczypospolitej Polskiej i Meksykańskich Stanów Zjednoczonych instytucjami rządowymi i pozarządowymi oraz osobami prawnymi i fizycznymi;

4)    zachęcanie krajowych związków sportowych, ośrodków przygotowań olimpijskich, ośrodków naukowo-badawczych oraz publicznych i niepublicznych placówek edukacyjnych działających w dziedzinie sportu do rozwijania bezpośrednich kontaktów i umacniania współpracy;

5)    sprzyjanie organizacji wspólnych spotkań, konferencji, sympozjów, a także szkoleń i staży oraz wizyt studyjnych, objętych programami wymiany sportowej;

6)    zachęcanie działających na terytorium Rzeczypospolitej Polskiej i Meksykańskich Stanów Zjednoczonych instytucji pozarządowych do współdziałania w kształtowaniu międzynarodowej polityki w dziedzinie sportu, przede wszystkim w drodze konsultacji i spotkań dwustronnych;

7)    wspieranie wymiany doświadczeń w dziedzinie zarządzania obiektami sportowymi oraz marketingu i zarządzania w sporcie;

8)    współdziałanie w zwalczaniu dopingu w sporcie poprzez promowanie działań edukacyjnych przy wsparciu krajowych i międzynarodowych instytucji działających w tym obszarze;

9)    wspieranie wymiany doświadczeń w dziedzinie organizacji dużych imprez sportowych;

10)    wspieranie kampanii i przedsięwzięć towarzyszących imprezom sportowym, ukierunkowanych na promowanie Rzeczypospolitej Polskiej i Meksykańskich Stanów Zjednoczonych jako celów wyjazdów turystycznych; oraz

11)    każdą inną formę współpracy uzupełniającą cele niniejszej umowy i uznaną przez Strony za korzystną.

Artykuł 4

PROGRAMY WYMIANY SPORTOWEJ

1.    Mając na celu owocną współpracę Strony będą koordynować i ułatwiać realizację programów wymiany sportowej między zainteresowanymi podmiotami ze strony Rzeczypospolitej Polskiej i ze strony Meksykańskich Stanów Zjednoczonych.

2.    Programy wymiany sportowej będą obejmować w szczególności:

a)    trenerów sportowych,

b)    sportowców,

c)    kierownictwo krajowych związków sportowych oraz innych instytucji pozarządowych działających w dziedzinie sportu,

d)    pracowników urzędu powołanego do obsługi Ministra Sportu i Turystyki Rzeczypospolitej Polskiej, pracowników Narodowej Komisji Kultury Fizycznej i Sportu Meksykańskich Stanów Zjednoczonych oraz odpowiednich instytucji rządowych działających w dziedzinie sportu.

e)    dyrektorów szkół o profilu sportowym,

f)    osoby zawodowo zajmujące się nauką o kulturze fizycznej, oraz

g)    innych specjalistów w dziedzinie sportu.

Artykuł 5

WSPÓŁPRACA NAUKOWA

Strony będą    wspierać    współpracę naukową    między polskimi

a meksykańskimi    ośrodkami    naukowo-badawczymi    oraz publicznymi

i niepublicznymi szkołami wyższymi działającymi w obszarze sportu, a także specjalistami i innymi osobami zajmującymi się kulturą fizyczną i sportem.

Artykuł 6

WYMIANA INFORMACJI

W celu ułatwienia współpracy w obszarach objętych niniejszą umową Strony, działając zgodnie z prawem obowiązującym w Rzeczypospolitej Polskiej oraz Meksykańskich Stanach Zjednoczonych będą prowadzić wymianę informacji w zakresie:

1)    organizacji sportu;

2)    finansowania sportu;

3)    stanu infrastruktury, jej finansowania i zarządzania nią;

4)    systemu kształcenia i szkolenia w sporcie;

5)    przygotowania i przeprowadzania dużych imprez sportowych;

6)    uregulowań prawnych mających zastosowanie do poszczególnych sportów; oraz

7)    innych spraw będących przedmiotem wzajemnego zainteresowania Stron.

Artykuł 7 FINANSOWANIE

Strony będą finansowały współpracę prowadzoną w ramach niniejszej umowy z przyznanych im środków budżetowych w zależności od ich dostępności, oceny budżetu oraz przepisów właściwego prawa krajowego.

Programy wymiany sportowej, o których mowa w niniejszej umowie będą finansowane w następujący sposób:

-    po stronie polskiej w całości przez podmioty w nich uczestniczące;

-    po stronie meksykańskiej ze środków, które będą przeznaczone na ten cel w budżecie Strony meksykańskiej, w zależności od ich dostępności oraz zasad określonych w obowiązujących przepisach prawa meksykańskiego.

Artykuł 8

ZMIANY I UZUPEŁNIENIA

Strony za obopólną zgodą mogą dokonywać zmian i uzupełnień niniejszej umowy w formie odrębnych protokołów, które będą stanowić integralną część niniejszej umowy.

Artykuł 9 INNE UMOWY

Niniejsza umowa nie ma wpływu na prawa i obowiązki Stron wynikające z innych umów międzynarodowych, których stronami są Rzeczpospolita Polska lub Meksykańskie Stany Zjednoczone, ani z ich członkostwa w organizacjach międzynarodowych.

Artykuł 10

ROZWIĄZYWANIE SPORÓW

Wszelkie rozbieżności dotyczące interpretacji i stosowania niniejszej umowy będą rozstrzygane w drodze negocjacji i bezpośrednich konsultacji między Stronami.

Artykuł 11

POSTANOWIENIA KOŃCOWE

1.    Niniejsza umowa wchodzi w życie po upływie trzydziestu (30) dni od dnia jej podpisania.

2.    Niniejsza umowa będzie obowiązywać przez okres trzech (3) lat. Okres obowiązywania niniejszej umowy ulega automatycznemu przedłużeniu o dalsze okresy trzyletnie, o ile żadna ze Stron jej nie wypowie przekazując pisemne powiadomienie drugiej Stronie, nie później jednak niż sześć (6) miesięcy przed upływem danego okresu.

3.    W przypadku wypowiedzenia niniejszej umowy programy i działania rozpoczęte w okresie jej obowiązywania będą kontynuowane do czasu ich zakończenia.

4.    Z dniem wejścia w życie niniejszej umowy traci moc Porozumienie o współpracy w dziedzinie sportu między Urzędem Kultury Fizycznej i Turystyki Rzeczypospolitej Polskiej a Komisją Narodową do Spraw Sportu Meksykańskich Stanów Zjednoczonych, podpisane w Warszawie dnia 4 listopada 1996 r.

Sporządzono w Mieście Meksyk dnia 24 kwietnia 2017 r. w dwóch jednobrzmiących egzemplarzach, każdy w językach polskim, hiszpańskim i angielskim, przy czym każdy z tych tekstów jest jednakowo autentyczny. W przypadku różnic w ich interpretacji tekst angielski będzie uważany za rozstrzygający.

CONVENIO ENTRE EL MINISTRO DEL DEPORTE Y TURISMO DE LA REPUBLICA DE POLONIA Y LA COMISIÓN NACIONAL DE CULTURA FISICA Y DEPORTE DE LOS ESTADOS UNIDOS MEXICANOS SOBRE COOPERACIÓN EN MATERIA DE DEPORTE

El Ministro del Deporte y Turismo de la RepOblica de Polonia y la Comisión Nacional de Cultura Fisica y Deporte de los Estados Unidos Mexicanos, en adelante denominados "las Partes”;

CONSIDERANDO la tradición de la relación amistosa entre las Partes y deseando un mayor desarrollo en sus relaciones y promoción;

DESEANDO desarrollar una cooperación benefica mutua entre las Partes en el campo del deporte;

CONSIDERANDO el papel que desempeńa el deporte en el proceso de desarrollo y fortalecimiento de las relaciones amistosas entre las Partes;

DESEANDO cooperar en el marco de las organizaciones internacionales de las que son miembros, en los campos a los que se refiere este Convenio;

TENIENDO PRESENTE las disposiciones del Convenio de Cooperación entre el Gobierno de la Republica de Polonia y el Gobierno de los Estados Unidos Mexicanos en el Campo de la Educación y la Cultura, firmado en Varsovia el 12 de junio de 1997;

Han acordado lo siguiente:

ARTICULO 1 Propósitos Generales

1.    Las Partes mutuamente promoveran y fortaleceran la cooperación y el intercambio de experiencias en el campo del deporte.

2.    Las Partes crearan las condiciones para una cooperación directa de las instituciones gubernamentales y no gubernamentales, asi como las personas fisicas y morales para alcanzar los propósitos de este Convenio.

3.    Las Partes apoyaran las iniciativas bilaterales polaco-mexicanas en el campo del deporte que sirvan para los propósitos de este Convenio.

4.    La cooperación en el marco de este Convenio se łlevara a cabo de acuerdo eon las disposiciones legałeś vigentes en la Republica de Polonia y los Estados Unidos Mexicanos.

ARTiCULO 2 Campos de Cooperación

Para el cumplimiento de los objetivos de este Convenio, las Partes desarrollaran la cooperación en los siguientes campos:

1)    educación y perfeccionamiento profesional en el deporte;

2)    deporte juvenil y de alto rendimiento;

3)    deporte para todos;

4)    infraestructura deportiva;

5)    información y documentación deportiva;

6)    medicina deportiva y lucha contra el dopaje;

7)    administración deportiva;

8)    deporte para personas eon discapacidad y la politica de igualdad de oportunidades a traves del deporte;

9)    promoción de la Republica de Polonia y de los Estados Unidos Mexicanos a traves del deporte;

10)    organización de grandes eventos deportivos;

11)    desarrollo de las ciencias de la cultura flsica y deporte, y

12)    cualquier otro campo de cooperación que las Partes consideren de mutuo beneficio y que sea complementaria al objetivo de este Convenio.

ARTICULO 3

Modalidades de Cooperación

La cooperación en los campos mencionados en el Articulo 2 se desarrollara en particular, a traves de:

1)    apoyo a la participación de deportistas, entrenadores deportivos y personal tecnico en las competencias organizadas en el territorio de la Republica de Polonia y los Estados Unidos Mexicanos;

2)    coordinación de los programas de intercambios deportivos a los que se refiere el Articulo 4;

3)    intercambio entre las Partes de información a que se refiere el Articulo 6 y apoyo a dicho intercambio entre las instituciones gubernamentales y no gubernamentales, asi como a personas fisicas y morales que operen en el territorio de la Republica de Polonia y los Estados Unidos Mexicanos;

4)    motivar a las uniones deportivas locales, los centros de preparación

para los Juegos Ollmpicos, los institutos cientlficos y de iiwestigación, asl como escuelas publicas y privadas que operen en el area del deporte para    que desarrollen contactos directos y fortalezcan la

cooperación;

5)    promover la    organización mutua de encuentros, conferencias,

simposios, asl como entrenamientos, practicas y visitas de estudio bajo los programas de intercambio deportivo;

6)    motivar a las instituciones no gubernamentales que operen en el territorio de la Republica de Polonia y los Estados Unidos Mexicanos, para cooperar en la creación de la polltica internacjonał en el area deportiva, especialmente a traves de consultas y encuentros bilaterales;

7)    promover el    intercambio de experiencias en el campo de la

administración de instalaciones deportivas, al igual que en la mercadotecnia y administración deportiva;

8)    co-actuar para luchar contra el dopaje en los deportes, a traves de actividades educativas, eon el apoyo de instituciones nacionales e internacionales que operan en esta area;

9)    promover el intercambio de experiencias en la organización de grandes eventos deportivos;

10)    apoyar las campańas y eventos deportivos que busquen la promoción de la Republica de Polonia y los Estados Unidos Mexicanos, como destinos turisticos, y

11)    cualquier otrą modalidad de cooperación que las Partes consideren de mutuo beneficio y que sea complementaria al objetivo de este Convenio.

ARTICULO 4

Programas de Intercambio Deportivo

1.    Considerando una cooperación fructifera, las Partes coordinaran y facilitaran la realización de programas de intercambio deportivo que se desarrollen entre instituciones interesadas de la Republica de Polonia y los Estados Unidos Mexicanos.

2.    Los programas de intercambio deportivo deberan, en particular, considerar:

a)    entrenadores deportivos;

b)    deportistas;

c)    directivos de las asociaciones nacionales de deporte y de otras instituciones no gubernamentales que operen en el area de la cultura flsica y deporte;

d)    empleados de la Oficina establecida para servir al Ministro del Deporte y Turismo de la Republica de Polonia y empleados de la Comisión Nacional de Cultura Fisica y Deporte de los Estados Unidos Mexicanos y de las instituciones gubernamentales correspondientes que operen en el area de deporte;

e)    directores de escuelas deportivas;

f)    personas que profesionalmente esten relacionadas eon las ciencias del deporte, y

g)    otros especialistas en el area de deporte.

ARTfCULO 5 Cooperación Cientifica

Las Partes promoveran la cooperación cientifica entre institutos polacos y mexicanos de ciencia e investigación, escuelas de enseńanza superior publica o privadas que operen en el area de deporte, asi como personas o especialistas en cultura fisica y deporte.

ARTICULO 6

Intercambio de Información

Con el fin de facilitar la cooperación en las areas objęto del presente Convenio, las Partes intercambiaran de conformidad con las leyes vigentes en la Republica de Polonia y los Estados Unidos Mexicanos, la información relativa a las siguientes areas:

1)    organización del deporte;

2)    financiamiento del deporte;

3)    condición, financiamiento y administración de la infraestructura deportiva;

4)    sistema de educación y entrenamiento deportivo;

5)    preparación y realización de grandes eventos deportivos;

6)    legislación aplicable a los diferentes deportes, y

7)    otras materias que sean de interes mutuo para las Partes.

ARTICULO 7 Financiamiento

Las Partes financiaran las actividades de cooperación desarrolladas en el marco del presente Convenio eon los recursos asignados en sus respectivos presupuestos, de conformidad eon la disponibilidad de los mismos, afectación presupuestal y lo dispuesto por su legislación nacional aplicable.

Los programas de intercambio deportivo previstos en este Convenio seran financiados de la manera siguiente:

-    Por la Parte polaca, en su totalidad por las instituciones que participan en ellos.

-    Por la Parte mexicana, eon fondos que seran diseńados en el presupuesto de la Parte mexicana de aeuerdo eon su disponibilidad y conforme a su legislación vigente.

ARTICULO 8

Modificaciones y Complementos

Por mutuo consentimiento, las Partes podran cambiar y complementar este Convenio en forma de Protocolos separados, los cuales constituiran parte integrante del presente Convenio.

ARTICULO 9 Otros Convenios

Este Convenio no afecta los derechos y obligaciones que las Partes hayan adquirido por virtud de otros aeuerdos internacionales de los cuales sean parte la Repóblica de Polonia o los Estados Unidos Mexicanos, o aquellos que resulten de su membresia en organizaciones internacionales.

ARTICULO 10 Solución de Controversias

Las discrepancias eon relación a la interpretación o instrumentación del presente Convenio seran resueltas por la vla de la negociación y mediante consultas directas entre las Partes.

ARTICULO 11 Disposiciones Finales

1.    El presente Convenio entrara en vigor treinta (30) dlas despuśs de la fecha de su firma.

2.    El presente Convenio sera valido por tres (3) ańos, el cual podrą renovarse automaticamente por periodos de igual duración, a menos que una de “Las Partes” manifieste a la Otrą, mediante notificación escrita, su decisión de darło por terminado, eon seis (6) meses de antelación al vencimiento de cada periodo.

3.    En caso de la terminación del Convenio, los programas y actividades permaneceran validos y continuaran hasta su terminación.

4.    Con la entrada en vigor del presente Com/enio, se dara por terminado el Acuerdo de Colaboración Interinstitucional en Materia Deportiva entre la Oficina de Cultura Fisica y Turismo de la Republica de Polonia y la Comisión Nacional del Deporte, firmado en Varsovia el 4 de noviembre de 1996.

Hecho en la Ciudad de Mexico, el 24 de abril de 2017, en dos ejemplares originales en idioma polaco, espańoi e ingles, siendo todos los textos igualmente validos. En caso de divergencia en la interpretación, el texto en ingles prevalecera.

AGREEMENT BETWEEN THE MINISTER OF SPORT AND TOURISM OF THE

REPUBLIC OF POLAND

AND THE NATIONAL COMMISSION OF PHYSICAL CULTURE AND SPORT OF

THE UNITED MEXICAN STATES ON CO-OPERATION IN THE FIELD OF SPORT

The Minister of Sport and Tourism of the Republic of Poland and the National Commission on Physical Culture and Sport of the United Mexican States, hereinafter referred to as “the Parties”;

CONSIDERING the tradition of friendly relations between the Parties and aiming at the further development of the relations and their promotion;

DESIRING to develop a mutual beneficial co-operation between the Parties in the field of sport;

APPRECIATING the role which sport plays in the process of developing and strengthening friendly relations between both countries;

DESIRING to co-operate within intemational organizations, of which they are members in the fields considered in this Agreement;

CONSIDERING the provisions of the Agreement between the Government of the Republic of Poland and the Govemment of the United Mexican States on Co-operation in the Field of Education and Culture, signed in Warsaw on June 12, 1997;

Have agreed as follows:

ARTICLE 1 General Purposes

1.    The Parties shall mutually promote and strengthen the co-operation and the exchange of experiences in the field of sport.

2.    The Parties shall create the conditions for the direct co-operation of governmental and non-governmental institutions as well as natural and legał persons in order to accomplish the purposes of this Agreement.

3.    The Parties shall support the bilateral Polish-Mexican initiatives in the field of sport which contribute to the purpose of this Agreement.

4. Co-operation within the framework of this Agreement shall be conducted in accordance with the law in force in the Republic of Poland and the United Mexican States.

ARTICLE 2

Areas of Co-operation

In order to accomplish the purposes of the Agreement, the Parties shall develop co-operation in the following areas:

1)    education and professional improvement in sport;

2)    top and youth sport;

3)    sport for all;

4)    sport infrastructure;

5)    sport Information and documentation;

6)    sport medicine and fighting doping;

7)    sport management;

8)    sport for the disabled and the policy of equal opportunities through sport;

9)    promotion of the Republic of Poland and the United Mexican States through sport;

10)    organisation of large sports events;

11)    development of physical culture and sport Sciences, and

12)    any other area of cooperation supplementary to the purposes of this Agreement that is deemed mutually beneficial by the Parties.

ARTICLE 3

Forms of Co-operation

Co-operation in the areas mentioned in Article 2 shall be developed, in particular, through:

1)    supporting the participation of sportsmen and sportswomen, sports coaches as well as technical personnel in sports competitions organized on the territory of the Republic of Poland and the United Mexican States;

2)    co-ordinating sport exchange programmes referred to in Article 4;

3)    exchanging between the Parties of information referred to in Article 6 and supporting such exchange between governmental and non-governmental institutions as well as natural and legał persons operating on the territory of the Republic of Poland and the United Mexican States;

4)    encouraging national sports federations, Olympic games preparation centres, scientific and research institutes as well as public and non-public educational institutions, operating in the field of sport to develop direct contacts and tighten co-operation;

5)    promoting the mutual organization of meetings, conferences, symposia as well as training, traineeships and studio visits under sports exchange programmes;

6)    encouraging non-governmental institutions operating in the territory of the Republic of Poland and the United Mexican States to co-operate in shaping international policy in the field of sport, especially, through consultations and bilateral meetings;

7)    promoting the exchange of experience in the field of managing sports facilities as well as in marketing and sport management;

8)    co-acting to fight doping in sport, through promoting educational activities with the support of national and international institutions operating in this field;

9)    promoting the exchange of experience in the field of organising large sports events;

10)    supporting campaigns and undertakings accompanying sports events, aimed at the promotion of the Republic of Poland and the United Mexican States as a tourist destination, and

11)    any other form of co-operation supplementary to the purposes of this Agreement where co-operation is considered beneficial by the Parties.

ARTICLE 4

Programmes of Sport Exchange

1.    Bearing in mind fruitful co-operation, the Parties shall coordinate and facilitate the realisation of sports exchange programmes between the interested entities of the Republic of Poland and the United Mexican States.

2.    The programmes of sports exchange shall, in particular, involve:

a)    sports coaches;

b)    sportsmen and sportswomen;

c)    management teams of the national sports associations as well as other non-governmental institutions operating in the field of physical culture and sport;

d)    employees of the Office established to serve the Minister of Sport and Tourism of the Republic of Poland as well as the employees of the National Commission of Physical Culture and Sport of the United Mexican States and the relevant governmental institutions operating in the field of sport;

e)    directors of sports schools;

f)    persons who are professionally engaged in physical culture Sciences, and

g)    other specialists in the field of sport.

ARTICLE 5

Scientific Co-operation

The Parties shall promote the scientific co-operation between Polish and Mexican scientific and research institutes, public and non-public higher education institutions operating in the field of sport, as well as persons or specialists in physical culture and sport.

ARTICLE 6

Exchange of Information

In order to facilitate co-operation in the areas covered by this Agreement, the Parties shall exchange information in compliance with the laws in force in the Republic of Poland and the United Mexican States, in the field of:

1)    organisation of sport;

2)    financing sport;

3)    condition, financing and management of the sport infrastructure;

4)    system of education and training in sport;

5)    preparation and conducting large sport events;

6)    legał regulations applicable to different sports, and

7)    other subjects which are of mutual interest to the Parties.

ARTICLE 7 Financing

The Parties shall finance the cooperation activities developed under this Agreement with the resources allocated in their budgets, according to the availability, budgetary appraisal and the provisions of their relevant national legislation.

The programmes of sports exchange referred to in this Agreement shall be financed in the following way:

-    By the Polish side, entirely by the participating entities.

-    By the Mexican side, with resources attributed to this aim in the

Mexican side’s budget, subject to their availability and the terms of

their applicable legislation.

ARTICLE 8

Amendments and Supplements

Upon mutual consent, the Parties may amend or supplement this Agreement in the form of separate Protocols which shall constitute an integral part of this Agreement.

ARTICLE 9 Other Agreements

This Agreement shall not affect the rights and obligations of the Parties resulting from other international agreements, to which the Republic of Poland or the United Mexican States are Parties, or those resulting from their membership in international organisations.

ARTICLE 10 Settlements of Disputes

Ali discrepancies regarding the interpretation and the application of this Agreement shall be settled through of negotiations and direct consultations between the Parties.

ARTICLE 11 Finał Provisions

1.    This Agreement shall enter into force thirty (30) days after the datę of its sig naturę.

2.    This Agreement shall remain in force for a period of three (3) years. This Agreement may be automatically renewed for further three-year periods unless any of the Parties notifies the other Party through written Communications of its decision of terminating this Agreement, six (6) months in advance to the end of a given period.

3.    In the event of terminating this Agreement, the programmes and activities remain valid and shall be continued until they are completed.

4.    From the datę of the entry into force of this Agreement, the Agreement on co-operation in the Field of Sport between the Office for Physical Culture and Tourism of the Republic of Poland and the National Commission of Sport of the Mexican United States, signed in Warsaw on November 4, 1996, shall be terminated.

Done in Mexico City on 24th of April 2017 in two originals, each in the Polish, Spanish and English languages, all texts being equally authentic. In case of divergences in the interpretation, the English text shall prevail.
