UMOWA

z dnia 15 lutego 2017 r.

między Rządem Rzeczypospolitej Polskiej a Rządem Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej o zmianie Umowy między Rządem Rzeczypospolitej Polskiej a Rządem Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej o wzajemnej ochronie informacji niejawnych, podpisanej w Warszawie dnia 18 sierpnia 2006 r.

Ambasada Brytyjska w Warszawie przesyła wyrazy szacunku Ministerstwu Spraw Zagranicznych Rzeczypospolitej Polskiej i ma zaszczyt powołać się na Umowę między Rządem Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej a Rządem Rzeczypospolitej Polskiej o wzajemnej ochronie informacji niejawnych, sporządzoną w Warszawie dnia 18 sierpnia 2006 roku, oraz prowadzone dotąd rozmowy pomiędzy przedstawicielami naszych Rządów, dotyczące zasadności zmiany wspomnianej wyżej Umowy w następstwie zmian wprowadzonych w systematyce brytyjskich klauzul tajności, które weszły w życie z dniem 2 kwietnia 2014 roku.

Działając na podstawie postanowień artykułu 16 ustęp 2 wymienionej Umowy, Rząd Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej ma zaszczyt zaproponować następujące zmiany do tej Umowy:

1) artykuł 3 otrzymuje następujące brzmienie:

„1. W rozumieniu niniejszej Umowy, niżej wymienione klauzule tajności są równorzędne:

2.    Informacje niejawne oznaczone klauzulą POUFNE są traktowane jak UK SECRET w Zjednoczonym Królestwie Wielkiej Brytanii i Irlandii Północnej.

3.    W przypadku potrzeby wymiany informacji niejawnych oznaczonych klauzulą UK TOP SECRET / ŚCIŚLE TAJNE, Strony przyjmą odrębne uzgodnienia.”;

2) artykuł 4 ustęp 1 otrzymuje następujące brzmienie:

„1. Krajowymi władzami bezpieczeństwa odpowiedzialnymi za bezpieczeństwo informacji niejawnych w każdym z krajów są:

W Zjednoczonym Królestwie Wielkiej Brytanii i Irlandii Północnej:

Cabinet Office 70 Whitehall London SW1A 2AS UNITED KENGDOM

W Rzeczypospolitej Polskiej:

Szef Agencji Bezpieczeństwa Wewnętrznego ul. Rakowiecka 2A 00-993 Warszawa POLSKA”;

3)    artykuł 6 ustęp 2 punkt 1 otrzymuje następujące brzmienie:

„1) Zapewnia informacjom otrzymanym od drugiej Strony przynajmniej taką samą ochronę, jaką zapewnia informacjom niejawnym o równorzędnych klauzulach tajności wytworzonym przez Stronę otrzymującą;”;

4)    artykuł 8 otrzymuje następujące brzmienie:

„1. Informacje niejawne oznaczone klauzulami UK SECRET / TAJNE lub POUFNE są przekazywane między obydwoma krajami zgodnie z prawem krajowym Strony wytwarzającej. Wymiana odbywa się zazwyczaj drogą dyplomatyczną, Strony mogą jednak dokonać innych ustaleń, jeśli zostaną one obustronnie zaakceptowane przez odpowiednie właściwe organy bezpieczeństwa.

2. Informacje niejawne oznaczone klauzulą UK OFFICIAL-SENSITIVE / ZASTRZEŻONE są przekazywane zgodnie z prawem krajowym Strony wytwarzającej.”;

5)    artykuł 10 ustęp 7 otrzymuje następujące brzmienie:

„7. Wizyty związane z dostępem do informacji o klauzuli UK OFFICIAL-SENSnWE / ZASTRZEŻONE są organizowane bezpośrednio między jednostką wysyłającą a jednostką przyjmującą wizytę.”;

6)    artykuł 11 ustęp 1 otrzymuje następujące brzmienie:

„1. W przypadku złożenia propozycji zawarcia lub upoważnienia kontrahenta ze swojego kraju do zawarcia kontraktu, którego realizacja wiąże się z dostępem do informacji niejawnych oznaczonych klauzulą UK SECRET / TAJNE lub POUFNE, z kontrahentem pochodzącym z kraju drugiej Strony, Strona wytwarzająca otrzymuje wcześniejsze zapewnienie od właściwego organu bezpieczeństwa drugiego kraju, że proponowany kontrahent spełnia warunki

bezpieczeństwa, a także posiada zabezpieczenia zapewniające właściwą ochronę informacji niejawnych. Zapewnienie takie jest jednoznaczne z gwarancją, że środki bezpieczeństwa stosowane przez kontrahenta spełniającego warunki bezpieczeństwa są zgodne z prawem krajowym właściwego organu bezpieczeństwa, który sprawuje nad nim kontrolę”;

7) artykuł 12 ustęp 2 otrzymuje następujące brzmienie:

„2. Na wniosek jednej ze Stron właściwy organ bezpieczeństwa drugiej Strony ustala, czy kontrahent lub osoba fizyczna będące przedmiotami postępowania dają rękojmię zachowania tajemnicy, oraz przesyła zapewnienie o posiadaniu poświadczenia bezpieczeństwa, jeżeli wobec kontrahenta lub osoby fizycznej przeprowadzono już postępowanie sprawdzające. W przypadku kiedy kontrahent lub osoba fizyczna nie posiada poświadczenia bezpieczeństwa lub posiada poświadczenie uprawniające do dostępu do informacji niejawnych objętych klauzulą niższą niż klauzula dokumentu, który ma być udostępniony, należy przesłać zawiadomienie informujące, iż zapewnienie o posiadaniu poświadczenia bezpieczeństwa nie może być przekazane natychmiast, ale podjęto działania mające na celu jego wydanie. Zapewnienie o posiadaniu świadectwa bezpieczeństwa przemysłowego lub poświadczenia bezpieczeństwa należy przekazać po pomyślnym zakończeniu postępowania sprawdzającego. Świadectwo bezpieczeństwa przemysłowego nie jest wymagane w przypadku dostępu do informacji oznaczonych klauzulą UK OFFICIAL-SEN SITIVE / ZASTRZEŻONE.”.

W przypadku gdy Rząd Rzeczypospolitej Polskiej przyjmie powyższą propozycję, Ambasada Brytyjska w Warszawie ma zaszczyt zaproponować, aby niniejsza nota wraz z notą stanowiącą odpowiedź Ministerstwa stanowiły Umowę między Rządem Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej a Rządem Rzeczpospolitej Polskiej o zmianie Umowy między Rządem Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej a Rządem Rzeczypospolitej Polskiej o wzajemnej ochronie informacji niejawnych, sporządzonej w Warszawie dnia 18 sierpnia 2006 roku, która wejdzie w życie pierwszego dnia drugiego miesiąca, który nastąpi po dniu otrzymania noty stanowiącej odpowiedź Ministerstwa.

Ambasada Brytyjska w Warszawie korzysta z okazji, aby ponowić Ministerstwu Spraw Zagranicznych Rzeczypospolitej Polskiej wyrazy swego wysokiego poważania.

The British Embassy in Warsaw presents its compliments to the Ministry of Forelgn Affairs of the Republic of Polane! and has the honour to refer to the Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Poland concerning the Mutual Protection of Classified Information, done at Warsaw on 18 August 2006 and to recent discussions between officials of our two Governments concerning the desirability of amending the aforesaid Agreement because of changes to the United Kingdom Classification System which came into effect on 2 April 2014.

In accordance with the amendment procedures of Article 16(2) of the Agreement, the Government of the United Kingdom of Great Britain and Northern Ireland has the honour to propose that the Agreement be amended as foliows:

1) Article 3 shail be deleted and replaced with:

"1. For the purpose of this Agreement the equivalent security ciassifications are:

2. The United Kingdom of Great Britain and Northern Ireland shail afford POUFNE Classified Information an equivalent level of protection as it would for UK SECRET.

3. In the event that Classified Information at the UK TOP SECRET / ŚCIŚLE TAJNE level needs to be exchanged, separate provisions shail be agreed between the Parties.";

2) Article 4, paragraph 1 shail be deleted and replaced with:

”1. The National Security Authorities responsible for the security of Classified Information in each country are:

For the United Kingdom of Great Britain and Northern Ireland:

For the Republic of Poland:

3)    Article 6, paragraph 2, sub-paragraph 1 shall be deleted and replaced with:

"1) Afford information received from the other Party at least a !evel of security protection that is afforded to Classified Information of an equivalent classification originated by the Recipient Party;";

4)    Article 8, shall be deleted and replaced with:

"1. Classified Information at the UK SECRET / TAJNE or POUFNE levels shall be transmitted between the two countries in accordance with the national law and regulations of the Originating Party. The normal route shall be through diplomatic channels, but other arrangements may be established if mutually acceptable to the respective Competent Security Authorities.

2. Classified Information at the UK OFFICIAL-SENSITIVE / ZASTRZEŻONE level shall be transmitted in accordance with the national law and regulations of the Originating Party.";

5)    Article 10, paragraph 7 shall be deleted and replaced with:

"7. Visits relating to Classified Information at the UK OFFICIAL-SENSITIVE / ZASTRZEŻONE level shall be arranged directly between the sending establishment and the establishment to be visited.";

6)    Article 11, paragraph 1 shall be deleted and replaced with:

"1. When proposing to place, or authorising a Contractor in its country to place, a Contract involving Classified Information at the UK SECRET / TAJNE or POUFNE level with a Contractor in the other country, the Originating Party shall obtain prior assurance from the Competent Security Authority of the other country that the proposed

Contractor is security cleared to the appropriate level, and also has suitable security safeguards to provide adequate protection for Classified Information. The assurance shall carry a responsibility that the security measures applied by the cleared Contractor shall be in accordance with national law and regulations and monitored by his Competent Security Authority.";

7) Article 12, paragraph 2 shall be deleted and replaced with:

"2. When requested, the Competent Security Authority shall establish the security clearance status of the Contractor or individual which is the subject of the enquiry and forward a security clearance assurance if the Contractor or individual is already cleared. If the Contractor or individual does not have a security clearance, or the clearance is at a lower security level than that which has been requested, notification shall be sent that the security clearance assurance cannot be issued immediately, but that action is being taken to process the request. Following successful enquiries an assurance of Facility Security Clearance or Personnel Security Clearance shall be provided. A Facility Security Clearance is not required for Information at the UK OFFICIAL-SENSITIVE / ZASTRZEŻONE level.".

If the foregoing proposal is acceptable to the Government of the Republic of Poland, the British Embassy in Warsaw has the honour to propose that this Notę and the Ministry's reply shall constitute an Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Poland amending the Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Poland concerning the Mutual Protection of Classified Information, done at Warsaw on 18 August 2006, which shall enter into force on the first day of the second month following the datę of receipt of the Ministry's reply.

The British Embassy in Warsaw avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Poland the assurance of its highest consideration.

Ministerstwo Spraw Zagranicznych Rzeczypospolitej Polskiej przesyła wyrazy szacunku Ambasadzie Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej w Warszawie i ma zaszczyt potwierdzić otrzymanie noty Ambasady nr 008/2017 z dnia 9 lutego 2017 roku, w której zaproponowano wprowadzenie zmian do Umowy między Rządem Rzeczypospolitej Polskiej a Rządem Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej o wzajemnej ochronie informacji niejawnych, sporządzonej w Warszawie dnia 18 sierpnia 2006 roku, w następującym brzmieniu:

2) artykuł 4 ustęp 1 otrzymuje następujące brzmienie:

3)    artykuł 6 ustęp 2 punkt 1 otrzymuje następujące brzmienie:

„1) Zapewnia informacjom otrzymanym od drugiej Strony przynajmniej taką samą ochronę, jaką zapewnia informacjom niejawnym o równorzędnych klauzulach tajności wytworzonym przez Stronę otrzymującą;”;

4)    artykuł 8 otrzymuje następujące brzmienie:

„1. Informacje niejawne oznaczone klauzulami UK SECRET / TAJNE lub POUFNE są przekazywane między obydwoma krajami zgodnie z prawem krajowym Strony wytwarzającej. Wymiana odbywa się zazwyczaj drogą dyplomatyczną, Strony mogą jednak dokonać innych ustaleń, jeśli zostaną one obustronnie zaakceptowane przez odpowiednie właściwe organy bezpieczeństwa.

5)    artykuł 10 ustęp 7 otrzymuje następujące brzmienie:

posiada zabezpieczenia zapewniające właściwą ochronę informacji niejawnych. Zapewnienie takie jest jednoznaczne z gwarancją, że środki bezpieczeństwa stosowane przez kontrahenta spełniającego warunki bezpieczeństwa są zgodne z prawem krajowym właściwego organu bezpieczeństwa, który sprawuje nad nim kontrolę.”;

7) artykuł 12 ustęp 2 otrzymuje następujące brzmienie:

„2. Na wniosek jednej ze Stron właściwy organ bezpieczeństwa drugiej Strony ustala, czy kontrahent lub osoba fizyczna będące przedmiotami postępowania dają rękojmię zachowania tajemnicy, oraz przesyła zapewnienie o posiadaniu poświadczenia bezpieczeństwa, jeżeli wobec kontrahenta lub osoby fizycznej przeprowadzono już postępowanie sprawdzające. W przypadku kiedy kontrahent lub osoba fizyczna nie posiada poświadczenia bezpieczeństwa lub posiada poświadczenie uprawniające do dostępu do informacji niejawnych objętych klauzulą niższą niż klauzula dokumentu, który ma być udostępniony, należy przesłać zawiadomienie informujące, iż zapewnienie o posiadaniu poświadczenia bezpieczeństwa nie może być przekazane natychmiast, ale podjęto działania mające na celu jego wydanie. Zapewnienie o posiadaniu świadectwa bezpieczeństwa przemysłowego lub poświadczenia bezpieczeństwa należy przekazać po pomyślnym zakończeniu postępowania sprawdzającego. Świadectwo bezpieczeństwa przemysłowego nie jest wymagane w przypadku dostępu do informacji oznaczonych klauzulą UK OFFICIAL-SENSflWE / ZASTRZEŻONE.”.

W przypadku gdy Rząd Rzeczypospolitej Polskiej przyjmie powyższą propozycję, Ambasada Brytyjska w Warszawie ma zaszczyt zaproponować, aby niniejsza nota wraz z notą stanowiącą odpowiedź Ministerstwa stanowiły Umowę między Rządem Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej a Rządem Rzeczypospolitej Polskiej o zmianie Umowy między Rządem Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej a Rządem Rzeczypospolitej Polskiej o wzajemnej ochronie informacji niejawnych, sporządzonej w Warszawie dnia 18 sierpnia 2006 roku,

która wejdzie w życie pierwszego dnia drugiego miesiąca, który nastąpi po dniu otrzymania noty stanowiącej odpowiedź Ministerstwa.

Ambasada    Brytyjska    w Warszawie korzysta z okazji,

aby ponowić Ministerstwu Spraw Zagranicznych Rzeczypospolitej Polskiej wyrazy swego wysokiego poważania.”

Ministerstwo Spraw Zagranicznych Rzeczypospolitej Polskiej ma zaszczyt potwierdzić, iż Rząd Rzeczpospolitej Polskiej wyraża w pełni zgodę    na powyższe, wobec czego    nota Ambasady

Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej w Warszawie nr 008/2017 z dnia 9 lutego 2017 roku wraz z notą niniejszą stanowią Umowę między Rządem Zjednoczonego Królestwa Wielkiej Brytanii    i Irlandii    Północnej a    Rządem    Rzeczypospolitej

Polskiej o zmianie Umowy między Rządem Zjednoczonego Królestwa Wielkiej Brytanii    i Irlandii    Północnej a    Rządem    Rzeczypospolitej

Polskiej o wzajemnej ochronie informacji niejawnych, sporządzonej w Warszawie dnia 18 sierpnia 2006 roku, która wejdzie w życie pierwszego dnia drugiego miesiąca następującego po dacie otrzymania niniejszej noty.

W związku z powyższym, Ministerstwo Spraw Zagranicznych Rzeczypospolitej Polskiej zwraca się z prośbą o potwierdzenie daty otrzymania niniejszej noty przez Ambasadę Zj ednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej w Warszawie, a tym samym o wyznaczenie daty wejścia w życie Umowy.

When proposing to place, or authorising a Contractor in its country to place, a Contract involving Classified Information at the UK SECRET / TAJNE or POUFNE level with a Contractor in the other country, the Originating Party shall obtain prior assurance from the Competent Security Authority of the other country that the proposed Contractor is security cleared to the appropriate level, and also has suitable security safeguards to provide adeąuate protection for Classified Information. The assurance shall carry a responsibility that the security measures applied by the cleared Contractor shall be in accordance with national law and regulations and monitored by his Competent Security Authority.";

7)    Article 12, paragraph 2 shall be deleted and replaced with:

“2. When reąuested, the Competent Security Authority shall establish the security clearance status of the Contractor or individual which is tiie subject of the enąuiry and forward a security clearance assurance if the Contractor or individual is already cleared. If the Contractor or individual does not have a security clearance, or the clearance is at a lower security level than that which has been reąuested, notification shall be sent that the security clearance assurance cannot be issued immediately, but that action is being taken to process the reąuest. Following successfiil enąuiries an assurance of Facility Security

Clearance or Personnel Security Clearance shall be provided. A Facility Security Clearance is not reąuired for infonnation at the UK OFFICIAL-SENSITWE / ZASTRZEŻONE level.”.

If the foregoing proposal is acceptable to the Govemment of the Republic of Poland, the British Embassy in Warsaw has the honour to propose that this Notę and the Ministry’s reply shall constitute an Agreement between the Govemment of the United Kingdom of Great Britain and Northern Ireland and the Govemment of the Republic of Poland amending the Agreement between the Govemment of the United Kingdom of Great Britain and Northern Ireland and the Govemment of the Republic of Poland conceming the Mutual Protection of Classified Information, done at Warsaw on 18 August 2006, which shall enter into force on the first day of the second month following the datę of receipt of the Ministiy’s reply.

The Ministry of Foreign Affairs of the Republic of Poland has the honour to confirm that the foregoing proposals are acceptable to the Govemment of the Republic of Poland and Notę No 008/2017 dated 9^<h of February 2017 firom the Embassy of the United Kingdom of Great Britain and Northern Ireland in Warsaw and this Notę of reply shall constitute an Agreement between the Govemment of the United Kingdom of Great Britain and Northern Ireland and the Govemment of the Republic of Poland amending the Agreement between the Govemment of the United Kingdom of Great Britain and Northern Ireland and the Govemment of the Republic of Poland conceming the Mutual Protection of Classified Information, done at Warsaw on 18 August 2006, which shall enter into force on the first day of the second month following the datę of receipt of this reply Notę.

The Ministry of Foreign Affairs of the Republic of Poland has therefore the honour to reąuest that the Embassy of the United Kingdom of Great Britain and Northern Ireland in Warsaw confirm the datę of receipt of this Notę and thus set the datę of entry into force of the Agreement.
