POROZUMIENIE

między Ministrem Nauki i Szkolnictwa Wyższego Rzeczypospolitej Polskiej a Ministerstwem Edukacji Chińskiej Republiki Ludowej o współpracy w dziedzinie szkolnictwa wyższego,

podpisane w Pekinie dnia 20 grudnia 2011 r.

i

Ministerstwo Edukacji Chińskiej Republiki Ludowej, zwani dalej „Stronami”

-    dążąc do wszechstronnego rozwijania i pogłębienia współpracy w dziedzinie szkolnictwa wyższego,

-    kierując się postanowieniami Umowy między Rządem Polskiej Rzeczypospolitej Ludowej a Rządem Chińskiej Republiki Ludowej o współpracy kulturalnej i naukowej, podpisanej w Pekinie dnia 30 września 1986 roku

uzgodnili, co następuje:

Artykuł 1

1. Obie Strony będą rozwijać współpracę w następujących dziedzinach:

1)    kształcenia studentów i doktorantów oraz doskonalenia nauczycieli akademickich,

2)    badań naukowych oraz upowszechniania nauczania języków polskiego i chińskiego,

3)    popierania bezpośredniej współpracy między uczelniami w zakresie wymiany nauczycieli akademickich oraz prowadzenia przez nich zajęć dydaktycznych i prac naukowo-badawczych,

4) wymiany doświadczeń, materiałów informacyjnych i dydaktycznych z zakresu planowania, rozwoju i zarządzania szkolnictwem wyższym oraz innych zagadnień dotyczących organizacji procesu kształcenia w uczelniach.

2. W ramach działań związanych z upowszechnianiem języków polskiego i chińskiego Strony będą popierały w szczególności tworzenie katedr lub innych jednostek organizacyjnych kształcących na kierunkach filologii polskiej w chińskich uczelniach i sinologii w polskich uczelniach, uruchamianie lektoratów języka polskiego i języka chińskiego oraz będą uwzględniały w wymianie akademickiej prowadzonej na podstawie artykułu 2, również studentów i doktorantów uczących się języka drugiej Strony. Obie Strony wyrażają zadowolenie z faktu utworzenia w Rzeczypospolitej Polskiej Instytutów Konfucjusza.

Artykuł 2

1.    Każda ze Stron skieruje każdego roku na studia lub staż naukowy w państwie drugiej Strony do 40 stypendystów, w tym: studentów studiów licencjackich lub inżynierskich i studentów studiów magisterskich, uczestników studiów doktoranckich oraz stażystów, w tym nauczycieli akademickich, wliczając w powyższy limit osoby, które uzyskały zgodę obydwu Stron na przedłużenie pobytu na rok kolejny.

2.    Okres nauki studentów studiów licencjackich lub inżynierskich i studentów studiów magisterskich oraz uczestników studiów doktoranckich ustala się zgodnie z przepisami uczelni państwa Strony przyjmującej, a okres stażu naukowego stażystów trwa nie dłużej niż 1 rok akademicki

3.    Strona wysyłająca zapewnia wypłaty stypendiów przeznaczonych na pokrycie kosztów utrzymania skierowanych osób.

4.    Strona wysyłająca powiadomi, z odpowiednim wyprzedzeniem, Stronę przyjmującą o terminie przyjazdu, środkach lokomocji oraz miejscach przekroczenia granicy przez osoby skierowane na studia lub staż naukowy.

5.    Strona przyjmująca nie pobiera opłat za kształcenie stypendystów oraz zapewnia odpłatne zakwaterowanie w domach studenckich, a także inne udogodnienia na takich samych warunkach, jakie odnoszą się do obywateli państwa Strony przyjmującej.

6.    Strona przyjmująca nie pokrywa kosztów podróży osób skierowanych przez drugą Stronę do miejsca nauki lub odbywania stażu naukowego i z powrotem.

7.    W uzasadnionych przypadkach Strona przyjmująca zorganizuje stypendystom nie znającym języka Strony przyjmującej niezbędny kurs językowy. Kandydaci na studia jednolite magisterskie oraz studia drugiego stopnia, a także studia doktoranckie oraz inne stypendia, mogą, za zgodą Strony przyjmującej, zastosować język inny niż języki obu Stron.

8.    Strona wysyłająca przekaże Stronie przyjmującej najpóźniej do dnia 30 kwietnia każdego roku imienną listę kandydatów oraz niezbędne dokumenty.

9.    Strona przyjmująca najpóźniej do dnia 15 lipca każdego roku powiadomi Stronę wysyłającą o decyzjach w sprawie przyjęcia tych osób.

10.    Warunki wjazdu oraz pobytu osób, o których mowa w ustępie 1, regulują przepisy Strony przyjmującej.

Artykuł 3

1.    Każda Strona będzie, zgodnie z zapotrzebowaniem drugiej Strony, kontynuować wysyłanie nauczycieli akademickich - specjalistów w dziedzinie języka polskiego do Chin jako nauczycieli lub lektorów w chińskich szkołach wyższych oraz specjalistów w dziedzinie języka chińskiego do Polski jako nauczycieli lub lektorów w polskich szkołach wyższych.

2.    Strona wysyłająca pokrywa koszty podróży nauczycieli akademickich, o których mowa w ustępie 1, do miejsca zatrudnienia i z powrotem.

3.    Uczelnia zatrudniająca nauczycieli akademickich, o których mowa w ustępie 1, w ramach niniejszego Porozumienia jest zobowiązana do:

1)    wypłacania wynagrodzenia, zgodnie z umową o pracę,

2)    zapewnienia odpłatnego lub bezpłatnego zakwaterowania w zależności od posiadanych możliwości,

3)    przestrzegania zasad i wywiązywania się z obowiązków określonych w umowie o pracę,

4)    udzielania pomocy w załatwieniu wszelkich niezbędnych formalności związanych z zatrudnieniem i pobytem w państwie Strony przyjmującej (wiza, zameldowanie, zezwolenie na pracę).

Artykuł 4

1.    W celu wzajemnego zapoznania się z sytuacją w dziedzinie rozwoju szkolnictwa wyższego, zacieśnienia więzi między uczelniami oraz wymiany doświadczeń na temat ich zarządzania, każda ze Stron będzie co roku organizować pobyty studyjne delegacji specjalistów w zakresie szkolnictwa wyższego drugiej Strony.

2.    Delegacje, o których mowa w ustępie 1, będą liczyć do 5 osób, a pobyt studyjny nie będzie przekraczał 7 dni. Strona wysyłająca poinformuje, najpóźniej z 2-miesięcznym wyprzedzeniem, Stronę przyjmującą o składzie delegacji i życzeniach dotyczących programu pobytu. Strona przyjmująca powinna udzielić odpowiedzi w terminie 20 dni od dnia otrzymania tych informacji.

3.    W sprawach związanych z finansowaniem delegacji postanawia się, co następuje:

1)    Strona wysyłająca pokrywa koszty podróży do stolicy państwa przyjmującego i z powrotem.

2)    Strona przyjmująca pokrywa koszty związane z wizytą delegacji na terytorium swojego państwa, zgodnie z przewidzianym programem pobytu (zakwaterowanie, wyżywienie, przejazdy, tłumaczenia, program kulturalny i inne).

Artykuł 5

Strona wysyłająca zapewni, że osoby uczestniczące w wymianie objętej niniejszym Porozumieniem będą posiadały ubezpieczenie na wypadek nagłych zachorowań lub następstw nieszczęśliwych wypadków.

Artykuł 6

Obie Strony będą prowadzić wymianę informacji i materiałów na temat systemów szkolnictwa wyższego państw obu Stron.

Artykuł 7

Strony będą organizować raz w roku spotkanie związane z oceną realizacji postanowień niniejszego Porozumienia oraz rozwoju współpracy dwustronnej.

Artykuł 8

Niniejsze Porozumienie nie wyklucza realizacji innych przedsięwzięć, jeśli zostaną one uzgodnione przez obie Strony.

Artykuł 9

Postanowienia niniejszego Porozumienia mogą być zmienione tylko za pisemną zgodą obu Stron, zgodnie z prawem wewnętrznym państw obu Stron.

Artykuł 10

1.    Niniejsze Porozumienie wchodzi w życie z dniem podpisania.

2.    Niniejsze Porozumienie jest zawarte na okres 4 lat i będzie automatycznie przedłużane na kolejne dwuletnie okresy, jeżeli żadna ze Stron nie wypowie go w formie pisemnej najpóźniej na 6 miesięcy przed upływem danego okresu obowiązywania.

3.    Wypowiedzenie niniejszego Porozumienia nie będzie miało wpływu na przedsięwzięcia podjęte i realizowane zgodnie z niniejszym Porozumieniem w czasie jego obowiązywania aż do czasu ich zakończenia.

Sporządzono w    ....... ....w dniu    .....20.44..roku

w dwóch jednobrzmiących egzemplarzach, każdy w językach: polskim, chińskim i angielskim, przy czym wszystkie teksty posiadają jednakową moc. W przypadku rozbieżności przy ich interpretacji tekst w języku angielskim będzie tekstem rozstrzygającym.

Agreement

between

the Minister of Science and Higher Education of the Republic of

Poland

and

the Ministry of Education of the People's Republic of China on cooperation in the area of higher education

The Minister of Science and Education of the Republic of Poland and

the Ministry of Education of the People's Republic of China, hereinafter referred to as the "Parties",

-    striving to thoroughly develop and deepen cooperation in the area of higher education,

-    guided by the provisions of the Agreement between the Government of the People*s Republic of Poland and the Government of the People's Republic of China on cultural and scientific cooperation, signed in Beijing on 30 September 1986,

have agreed as follows:

Article 1

1. Both Parties shall develop their cooperation in the following areas:

1)    educating students and PhD students, as well as improving skills of academic teachers,

2)    scientific research and promotion of teaching the Polish and Chinese languages,

3)    supporting direct cooperation between higher education institutions in the area of the exchange of academic teachers, as well as classes and scientific research conducted by the above-mentioned teachers,

4) exchange of experience, information and didactic materials in the field of planning, development and management of the higher education, as well as other issues concerning organisation of the educational process in higher education institutions.

2. The Parties shall, within the framework of activities relating to the promotion of the Polish and Chinese languages, support in particular establishment of departments or other organisational units teaching Polish language and literaturę in Chinese higher education institutions and teaching Chinese language and literaturę in Polish higher education institutions, as well as organisation of Polish and Chinese language courses. Furthermore, they shall also take into account, in the course of academic exchange pursued in accordance with the provisions of article 2, students and PhD students learning the language of the other Party. Both Parties express their satisfaction with the fact of establishing Confucius Institutes in the Republic of Poland.

Article 2

1.    Each Party shall each year send up to 40 persons for studies or academic scholarships held in the other Party, including: students of undergraduate or engineer and master courses, students of postgraduate courses, as well as scholarship holders, including academic teachers. The above mentioned limit of persons shall take into account persons who obtained permissions of both Parties to extend their stay for another year.

2.    The education period for students of undergraduate or engineer courses and students of master courses, as well as PhD students, shall be determined in accordance with the regulations of higher education institutions of the receiving Party. The duration of academic scholarships shall be no morę than one academic year.

3.    The sending Party shall ensure payment of grants to cover costs of living of persons sent to the other Party.

4.    The sending Party shall in advance notify the receiving Party about the datę of arrival, means of transportation and places in which persons sent for studies or academic scholarships cross the border.

5.    The receiving Party shall not charge any fees for the education of the scholarship and grant holders, as well as shall ensure accommodation against payment, and other facilities under the same conditions that apply to its own citizens.

6.    The receiving Party shall cover neither travel costs of persons sent by the other Party to the place of studies or academic scholarship nor costs of their return travel.

7.    In justified cases, the receiving Party shall organise necessary language courses for the scholarship and grant holders who do not know the language of the receiving Party. Master and Ph.D. candidates as well as other academic scholarships, upon the consent of the receiving Party, may resort to a third language other than the official languages of the two Parties as the working language.

8.    Each year, the sending Party shall submit to the receiving Party, by 30 Aprll at the latest, the list of candidate names and necessary documents.

9.    Not later than by 15 July each year, the receiving Party shall notify the sending Party about decisions concerning admission of the above mentioned persons.

10.    Terms and conditions for the entry and stay of persons referred to in paragraph 1 shall be regulated by the provisions of the receiving Party.

Article 3

1.    Both Parties shall, in accordance with the demand reported by the other Party, continue to send academic teachers - experts on the Polish language to China as teachers or lectors in Chinese higher education institutions and experts on the Chinese language to Poland as teachers or lectors in Polish higher education institutions.

2.    The sending Party shall cover travel costs of academic teachers referred to in section 1 to the place of their employment and costs of their return travel.

3.    The higher education facility employing academic teachers referred to in section 1 shall be obliged within the framework of this Agreement to:

1)    pay remuneration in accordance with the provisions of the contract of employment,

2)    ensure accommodation, either free of charge or against payment, depending on the facility's possibilities,

3)    observe rules and fulfil obligations laid down in the contract of employment,

4)    provide assistance in taking care of all necessary formalities linked with the employment and stay in the receiving Party (visas, residence registration, work permit).

Article 4

1.    In order to become mutually acquainted with developments in the higher education systems, to tighten contacts between higher education institutions, as well as to exchange information on their management, each of the Parties shall each year organise study visits for the teams of the other Party's experts in the field of higher education.

2.    The teams referred to in section 1 shall be composed of 5 persons at maximum, and the study visits shall not exceed 7 days. The sending Party shall notify the receiving Party, 2 months in advance at the latest, about the composition of the team and its requests concerning agenda of the visit. The receiving Party should reply within 20 days as from the datę of receiving the above mentioned information.

3.    In matters relating to the financing of the teams, the Parties hereby agree as follows:

1)    the sending Party shall cover costs of travel to the Capital of the receiving Party and costs of the return travel.

2) the receiving Party shall cover costs linked with the stay of the team in its territory in accordance with the anticipated visit agenda (accommodation, meals, travels, translation services, cultural activities and other items).

Article 5

The sending Party shall ensure that persons participating in the exchange provided for in this Agreement shall be insured against unexpected sickness or accidents.

Article 6

Both Parties shall exchange information and materials on the systems of education in both Parties.

Article 7

Once a year, the Parties shall hołd a meeting dedicated to the implementation of the provisions of this Agreement and development of the bilateral cooperation.

Article 8

This Agreement does not exclude possibility to implement other projects should they be agreed upon by both Parties.

Article 9

Provisions of this Agreement may be amended only subject to the written consent of both Parties and in accordance with the internal legislation of both Parties.

Article 10

1.    This Agreement shall enter into force on the day of its signing.

2.    This Agreement shall be concluded for the term of 4 years and shall be automatically extended for subsequent two-year terms provided that no Party terminates it in writing by giving notice 6 months before expiry of a given term at the latest.

3.    Termination of this Agreement shall have no effect on projects launched during the term of this Agreement and being implemented in accordance with its provisions until they are completed.
