UMOWA

między Rządem Rzeczypospolitej Polskiej a Rządem Republiki Kolumbii o zniesieniu obowiązku wizowego

dla posiadaczy paszportów dyplomatycznych,

podpisana w Nowym Jorku dnia 25 września 2012 r.

Rząd Rzeczypospolitej Polskiej i Rząd Republiki Kolumbii, zwane dalej „Umawiającymi się Stronami",

-    PRAGNĄC zacieśnić przyjazne stosunki pomiędzy obydwoma krajami;

-    PRAGNĄC ułatwić wjazd, wyjazd oraz podróżowanie między obydwoma krajami ich obywatelom legitymującym się paszportami dyplomatycznymi;

-    ZGODNIE z obowiązującymi przepisami prawa obydwu krajów;

uzgodniły, co następuje:

Artykuł 1

ZWOLNIENIE Z OBOWIĄZKU WIZOWEGO

1.    Obywatele    jednej    Umawiającej    się    Strony,    legitymujący    się    paszportami

dyplomatycznymi wydanymi przez tę Umawiającą się Stronę, zwanymi dalej „paszportami dyplomatycznymi", są uprawnieni do wjazdu, wyjazdu i tranzytu przez terytorium drugiej Umawiającej się Strony bez wiz, korzystając z przejść granicznych przeznaczonych do obsługi ruchu międzynarodowego.

2.    Obywatele    jednej    Umawiającej    się    Strony    legitymujący    się    paszportami

dyplomatycznymi są uprawnieni do pobytu na terytorium drugiej Umawiającej się Strony bez wiz, przez okres nie dłuższy niż 90 (dziewięćdziesiąt) dni w okresie 180 (stu osiemdziesięciu) dni od daty pierwszego wjazdu, z zastrzeżeniem Artykułu 2.

Artykuł 2

CZŁONKOWIE MISJI DYPLOMATYCZNYCH ORAZ URZĘDÓW KONSULARNYCH

1.    Obywatele jednej Umawiającej się Strony, legitymujący paszportami dyplomatycznymi, oddelegowani do pracy w misji dyplomatycznej lub urzędzie konsularnym na terytorium drugiej Umawiającej się Strony, są uprawnieni do wjazdu na terytorium drugiej Umawiającej się Strony bez konieczności ubiegania się o wydanie wizy. W ciągu 90 (dziewięćdziesięciu) dni od dnia przyjazdu tych osób na terytorium Umawiającej się Strony przyjmującej, na wniosek zainteresowanej misji dyplomatycznej zostaną im wydane, na czas ich pobytu służbowego, zezwolenia na pobyt na terytorium tej Umawiającej się Strony.

2.    Uprawnienia, o których mowa w ustępie 1 przysługują również członkom rodzin oddelegowanych obywateli, pod warunkiem że członkowie rodzin legitymują się paszportami dyplomatycznymi oraz pozostają z oddelegowanymi obywatelami we wspólnym gospodarstwie domowym.

3.    Ministerstwa Spraw Zagranicznych Umawiających się Stron będą, z odpowiednim wyprzedzeniem, notyfikować sobie wzajemnie o osobach, o których mowa w ustępach 1 i 2.

Artykuł 3

UPRAWNIENIA WŁADZ

1.    Obywatele jednej Umawiającej się Strony legitymujący się paszportami dyplomatycznymi, zobowiązani są do przestrzegania przepisów prawa drugiej Umawiającej się Strony przy przekraczaniu jej granicy oraz przez cały okres swojego pobytu na jej terytorium.

2.    Każda z Umawiających się Stron zastrzega sobie prawo do odmowy wjazdu lub do skrócenia pobytu obywatelowi drugiej Umawiającej się Strony legitymującemu się paszportem dyplomatycznym, którego obecność na swym terytorium uzna za niepożądaną.

Artykuł 4

UTRATA LUB ZNISZCZENIE PASZPORTU

W przypadku, gdy obywatel jednej Umawiającej się Strony utraci paszport dyplomatyczny na terytorium drugiej Umawiającej się Strony, albo paszport taki ulegnie zniszczeniu na terytorium drugiej Umawiającej się Strony, zobowiązany jest on niezwłocznie powiadomić o tym właściwe władze Państwa przyjmującego za pośrednictwem misji dyplomatycznej lub urzędu konsularnego swego kraju, mającego siedzibę na terytorium Państwa przyjmującego, w celu podjęcia stosownych działań. Właściwa misja dyplomatyczna lub urząd konsularny wyda swojemu obywatelowi nowy dokument podróży uprawniający do przekraczania granicy państwowej, zgodnie z przepisami Państwa wysyłającego oraz powiadomi o tym właściwe władze Państwa przyjmującego.

Artykuł 5

NOTYFIKACJA WZORÓW PASZPORTÓW DYPLOMATYCZNYCH

1.    Dla celów niniejszej Umowy Umawiające się Strony przekażą sobie drogą dyplomatyczną, wzory wydawanych przez siebie paszportów dyplomatycznych wraz z ich szczegółowym opisem, nie później niż 30 (trzydzieści) od dnia podpisania niniejszej Umowy.

2.    Umawiające się Strony przekażą sobie drogą dyplomatyczną wzory swoich nowych lub zmienionych paszportów dyplomatycznych co najmniej 30 (trzydzieści) dni przed ich wprowadzeniem.

Artykuł 6 ZAWIESZENIE

1.    Każda z Umawiających się Stron zastrzega sobie prawo do czasowego zawieszenia stosowania niniejszej Umowy w całości lub części ze względu na bezpieczeństwo narodowe, bezpieczeństwo publiczne, porządek publiczny lub ochronę zdrowia publicznego.

2.    Decyzja o zawieszeniu, jak również o uchyleniu zawieszenia niniejszej Umowy będzie niezwłocznie notyfikowana drogą dyplomatyczną drugiej Umawiającej się Stronie.

Artykuł 7

ZMIANY

Każda z Umawiających się Stron może wystąpić na piśmie, drogą dyplomatyczną, o dokonanie zmiany całości lub części niniejszej Umowy. Każda zmiana lub uzupełnienie Umowy uzgodnione przez Umawiające się Strony wejdzie w życie w trybie przewidzianym dla wejścia w życie niniejszej Umowy i będzie stanowić jej integralną część.

Artykuł 8

ROZSTRZYGANIE SPORÓW

Wszelkie rozbieżności lub spory wynikające z interpretacji lub wykonywania niniejszej Umowy będą rozstrzygane polubownie na drodze konsultacji lub negocjacji między Umawiającymi się Stronami, bez odwoływania się do stron trzecich lub sądu międzynarodowego.

Artykuł 9

WEJŚCIE W ŻYCIE, CZAS OBOWIĄZYWANIA I WYPOWIEDZENIE

1.    Niniejsza Umowa wchodzi w życie po upływie 30 (trzydziestu) dni od daty otrzymania drogą dyplomatyczną ostatniej z notyfikacji, którymi Umawiające się Strony informują się nawzajem o spełnieniu wewnętrznych wymogów prawnych niezbędnych do wejścia w życie Umowy.

2.    Niniejsza Umowa zostaje zawarta na czas nieokreślony. Każda z Umawiających się Stron może ją wypowiedzieć w drodze notyfikacji, przekazanej drogą dyplomatyczną. W takim przypadku Umowa utraci moc obowiązującą po upływie 90 (dziewięćdziesięciu) dni od otrzymania notyfikacji ojej wypowiedzeniu.

SOBRE LA EXENCIÓN DE VISAS PARA TITULARES DE PASAPORTES

DIPLOMATICOS

El Gobiemo de la Republica de Polonia y el Gobierno de la Republica de Colombia, referidos en adelante como las “Partes Contratantes”,

-    DESEANDO fortalecer las relaciones amistosas entre los dos palses,

-    DESEANDO facilitar el Ingreso, salida y transita entre ambos paises para sus ciudadanos que porten pasaportes diplomaticos,

-    DE CONFORMIDAD eon la legislación aplicable de ambos paises,

Han acordado lo siguiente:

Articulo 1

EXENCIÓN DE VISAS

1.    Los nacionales de una Parte Contratante que porten pasaportes diplomaticos, expedidos por esa Parte Contratante, referidos en adelante como los “Pasaportes Diplomaticos”, tendrśn derecho de ingresar, salir y transitar sin visas por el territorio de la otrą Parte Contratante, utilizando los puntos de frontera designados para trafico de pasajeros intemacionales.

2.    Sujeto al Articulo 2, los nacionales de una de las Partes Contratantes que porten Pasaportes Diplomaticos podran permanecer sin visas en el territorio de la otrą Parte Contratante por un periodo hasta de 90 (noventa) dias durante un periodo de 180 (ciento ochenta) dias a partir de su primera entrada.

Articulo 2

MIEMBROS DE MISIONES DIPLOMAT1CAS Y OFICINAS CONSULARES

1.    Los nacionales de cualquiera de las Partes Contratantes que porten Pasaportes Diplomaticos, asignados para trabajar en una misión diplomśtica u oficina consular en el territorio de la otrą Parte Contratante, tendrśn el derecho a ingresar al territorio de dicha Parte Contratante sin necesidad de aplicar a visa. Por solicitud de la misión diplomatica interesada, a los ciudadanos antes mencionados se expedira un documento que legalice su permanencia por el periodo de su estadia oficiał, dentro de 90 (noventa) dias siguientes a su llegada al territorio de esa Parte Contratante.

2.    El mecanismo que se prevó en el Parśgrafo 1 sera aplicable a los miembros de las familias de las personas que se refieren en dicho Paragrafo, siempre y cuando porten pasaportes diplomśticos y formen parte del mismo hogar.

3.    Los Ministerios de Relaciones Exteriores de las Partes Contratantes se notificaran entre si eon la debida antelación acerca de las personas que se refieren en los Paragrafos 1 y 2.

Articulo 3

ATRIBUCIONES DE LAS AUTORIDADES

1.    Los nacionales de una de las Partes Contratantes que porten Pasaportes Diplomśticos estan obligados a respetar las leyes aplicables en el territorio de la otrą Parte Contratante en el momento de cruzar la frontera y durante toda su permanencia en el territorio de la otrą Parte Contratante.

2.    Cada una de las Partes Contratantes tendra el derecho de rechazar el ingreso o reducir la permanencia de un nacional de la otrą Parte Contratante, titular de Pasaporte Diplomatico, cuya presencia en el territorio se considere indeseable.

Articulo 4

PERDIDA O DANO DE UN PASAPORTE

En caso de perdida de un Pasaporte Diplomatico por un ciudadano de una de las Partes Contratantes en el territorio de la otrą Parte Contratante, o en caso de dano de su Pasaporte Diplomatico en el territorio de la otrą Parte Contratante, esta persona deberś notificar de inmediato a las autoridades competentes del Estado receptor a traves de la misión diplomatica u oficina consular de su pais de origen, eon sede en el Estado Receptor, eon el fin de que śstas puedan tomar las medidas apropiadas. La misión diplomśtica u oficina consular correspondiente expedira un nuevo documento de viaje a esta persona, para permitirle cruzar las fronteras estatales, de aeuerdo eon las leyes del Estado que envia, e informara este hecho a las autoridades competentes del Estado Receptor.

Articulo 5

NOTIFICACIÓN SOBRE MUESTRAS DE PASAPORTES

1.    Para los fines del presente acuerdo, las Partes Contratantes intercambiaran, a travśs de canales diplomśticos, muestras actualizadas de sus pasaportes diplomśticos, junto eon su descripción detallada, a mas tardar 30 (treinta) dias siguientes a la firma de este Acuerdo.

2.    Las Partes Contratantes intercambiarśn, a traves de canales diplomśticos, información sobre las muestras nuevas o modificadas de sus Pasaportes Diplomśticos, a mśs tardar 30 (treinta) dias antes de su aplicación oficial.

Articulo 6 SUSPENSIÓN

1.    Cualquiera de las Partes Contratantes podrą suspender temporalmente la aplicación del presente Acuerdo, en su totalidad o en parte, por razones de seguridad nacional, seguridad publica, orden publico o salud publica.

2.    La suspensión, asi como la revocatoria de la suspensión a que hace referencia el Parśgrafo 1 de este Articulo serś notificada inmediatamente a la otrą Parte Contratante a travśs de canales diplomśticos.

Articulo 7 MODIFICACIONES

Cualquiera de las Partes Contratantes podrś solicitar por escrito, a traves de canales diplomśticos, la modificación de la totalidad o parte de este Acuerdo. Toda modificación o complemento del Acuerdo que sea convenido por las Partes Contratantes entrarś en vigor de acuerdo eon los procedimientos de entrada en vigor del Acuerdo y formarś parte integral del mismo.

Articulo 8

RESOLUCIÓN DE CONTROVERSIAS

Cualquier tipo de discrepancia o controversia que surja en relación eon la interpretación o implementación de lo estipulado en el presente Acuerdo serś resueita de manera amistosa, por medio de consultas o negociaciones entre las Partes Contratantes, sin referirse a terceras partes o tribunales internacionales.

Arffculo 9

ENTRADA EN VIGOR, DURACIÓN Y TERMINACIÓN DEL ACUERDO

1. El presente Acuerdo entrara en vigor 30 (treinta) dfas siguientes a la fecha de recibo, a traves de canales diplomaticos, de la Oltima notificación en la que las Partes Contratantes se notifiquen sobre la finalización de todos los procedimientos legałeś intemos requeridos para la entrada en vigor de este Acuerdo.

2. El presente Acuerdo se firma por un periodo indefinido. Cada una de las Partes Contratantes podrą terminar este Acuerdo mediante notificación a traves de canales diplomaticos. En tai caso, el Acuerdo expirara 90 (noventa) dias siguientes a la fecha en que se reciba la notificadón de la terminadón.

En testimonio de lo cual, los suscritos debidamente autorizados por sus respectivos Gobiemos firman este Acuerdo.

AGREEMENT

BETWEEN THE GOVERNMENT OF THE REPUBLIC OF POLAND AND THE GOVERNMENT OF THE REPUBLIC OF COLOMBIA ON THE EXEMPTION FROM VISAS FOR HOLDERS OF DIPLOMATIC PASSPORTS

The Government of the Republic of Poland and the Government of the Republic of Colombia, hereinafter referred to as the "Contracting Parties",

-    DESIRING to strengthen friendly relations between the two countries,

-    DESIRING to facilitate entry to, departure from, and travel between both countries for their citizens holding diplomatic passports,

-    PURSUANT to the applicable laws of both countries, have agreed as follows:

Articłe 1

EXEMPTION FROM VISAS

1.    Citizens of one Contracting Party holding diplomatic passports, issued by that Contracting Party, hereinafter referred to as the "diplomatic passports", shall have the right to enter, exit, and transit through the territory of the other Contracting Party without visas, through border Crossing points designated for international passenger traffic.

2.    Citizens of one Contracting Party holding diplomatic passports shall have the right to stay without visas in the territory of the other Contracting Party for a period of up to 90 (ninety) days during a period of 180 (one hundred and eighty) days from the datę of their first entry, subject to Article 2.

Article 2

MEMBERS OF DIPLOMATIC MISSIONS AND CONSULAR POSTS

1.    Citizens of either Contracting Party holding diplomatic passports, assigned to work in a diplomatic mission or consular post in the territory of the other Contracting Party, shall have the right to enter the territory of that Contracting Party without the need to apply for a visa. At the request of the interested diplomatic mission, the aforementioned citizens shall be issued a document legalizing their stay for the period of his/her official stay, within 90 (ninety) days from the datę of his/her arrival to the territory of that Contracting Party.

2.    The facilities envisaged in paragraph 1 shall apply to family members of the persons referred to in that paragraph, provided that they hołd diplomatic passports and form part of his/her household.

3.    The Ministries of Foreign Affairs of the Contacting Parties shall notify each other in due advance about persons referred to in paragraphs 1 and 2.

Article 3

POWERS OF AUTHORITIES

1.    The citizens of one Contracting Party holding diplomatic passports are required to respect the laws applicable in the territory of the other Contracting Party while Crossing the border and during the entire stay in the territory of the other Contracting Party.

2.    Each Contracting Party shall have the right to refuse entry or shorten the stay of a Citizen of the other Contracting Party holding diplomatic passport, whose presence in its territory is deemed undesirable.

Article 4

LOSS OR DAMAGE OF A PASSPORT

In the event of loss of a diplomatic passport by a Citizen of one Contracting Party in the territory of the other Contracting Party, or in the event of damage to his/her diplomatic passport in the territory of the other Contracting Party, this person shall immediately notify the relevant authorities of the receiving State through the diplomatic mission or consular post of his/her country of origin sited in the receiving State, so that they may take appropriate action. The re!evant diplomatic mission or consular post will issue a new trave! document to this person enabling him/her to cross State borders, pursuant to the laws of the sending State, and inform about it to the competent authorities of the receiving State.

Artide 5

NOTIFICATION OF PASSPORT SPECIMENS

1.    For the purposes of this Agreement, the Contracting Parties shall, through diplomatic channels, exchange current specimens of their diplomatic passports, together with their detailed descriptions, no later than 30 (thirty) days after the signing of this Agreement.

2.    The Contracting Parties shall, through diplomatic channels, exchange information on their new or amended specimens of diplomatic passports no later than 30 (thirty) days before their official introduction.

Artide 6 SUSPENSION

1.    Either Contracting Party shall have the right to temporarily suspend the implementation of this Agreement in whole or in part for reasons of national security, public security, public order or public health.

2.    The suspension, as well as revocation of the suspension referred to in paragraph 1 of this Artide shall be immediately notified to the other Contracting Party through diplomatic channels.

Artide 7 AMENDMENTS

Either Contracting Party may request in writing, through diplomatic channels, amendment of the whole Agreement or its part. Any amendment or supplementation of the Agreement, agreed to by the Contracting Parties, shall enter into force in accordance with the procedures for the entry into force of the Agreement itself and shall form its integral part.

Artide 8

SETTLEMENT OF DISPUTES

Any discrepancies or disputes arising in connection with the interpretation or implementation of the provisions of this Agreement shall be settled amicably, by way of consultations or negotiations between the Contracting Parties, without reference to third parties or an international court.

Article 9

ENTRYINTO FORCE, DURATION AND TERMINATION OF THE AGREEMENT

1.    This Agreement shall enter into force 30 (thirty) days after the datę of receiving, through diplomatic channels, the later notification in which the Contracting Parties shall notify each other of the completion of ali internal legał procedures required for the entry into force of this Agreement.

2.    This Agreement is concluded for an indefinite period of time. Each Contracting Party may terminate this Agreement by notification through diplomatic channels. In such event the Agreement will expire after 90 (ninety) days from the datę of receiving the notification of termination.

IN WITNESS WHEREOF the undersigned, being duły authorized by their respective Governments, have entered into this Agreement.
