UMOWA

między Rządem Rzeczypospolitej Polskiej a Rządem Republiki Mołdawii o współpracy w dziedzinie turystyki,

sporządzona w Kiszyniowie dnia 28 marca 2014 r.

Rząd Rzeczypospolitej Polskiej i Rząd Republiki Mołdawii, zwane dalej „Stronami”,

-    uznając potrzebę stworzenia podstaw prawnych dla współpracy w dziedzinie turystyki;

-    pragnąc przyczyniać się do dalszego rozwijania przyjacielskich kontaktów między społeczeństwami Rzeczypospolitej Polskiej i Republiki Mołdawii;

-    świadome znaczenia turystyki dla rozwoju kontaktów gospodarczych i kulturalnych,

jak również dla lepszego poznania życia, historii oraz dziedzictwa kulturowego obu narodów;

Uzgodniły, co następuje:

Artykuł 1

Strony będą sprzyjać rozwojowi współpracy w dziedzinie turystyki na zasadach równości, wzajemnych korzyści, zgodnie z prawem obowiązującym w obu państwach Stron i postanowieniami niniejszej Umowy.

Artykuł 2

Strony będą popierać nawiązywanie i rozwój współpracy między polskimi i mołdawskimi biurami podróży, organizatorami i pośrednikami turystycznymi oraz organizacjami, działającymi w dziedzinie turystyki.

Artykuł 3

Strony będą zachęcać do:

1)    wymiany materiałów informacyjnych i promocyjnych;

2)    udziału w targach, seminariach, wystawach i konferencjach turystycznych, a także przekazywania wykazu imprez turystycznych odbywających się w państwach obu Stron;

3)    organizacji wyjazdów studyjnych dla przedstawicieli administracji właściwej do spraw turystyki, środków masowego przekazu oraz organizatorów i pośredników turystycznych w celu zapoznania się z potencjałem turystycznym i kulturowym w Rzeczypospolitej Polskiej i Republice Mołdawii;

4)    opracowywania projektów rozwoju turystyki z wykorzystaniem funduszy unijnych;

5)    przeprowadzania innych turystycznych imprez promocyjnych.

Artykuł 4

Strony będą popierać wymianę informacji w zakresie:

1)    aktów prawnych regulujących działalność turystyczną;

2)    statystyki turystycznej;

3)    warunków inwestowania w zakresie turystyki.

Artykuł 5

Strony będą sprzyjać wymianie informacji oraz ekspertów, a także organizacji szkoleń dla pracowników zatrudnionych w sektorze turystyki w zakresie interesującym dla obu Stron.

Artykuł 6

Strony będą sprzyjać rozwojowi inwestycji w sektorze turystycznym.

Artykuł 7

Każda ze Stron będzie sprzyjać powstawaniu na terytorium swojego państwa ośrodków informacji turystycznej drugiej Strony zgodnie z prawem obowiązującym w danym państwie.

Artykuł 8

Strony będą wymieniać informacje i dzielić się doświadczeniami związanymi z ich udziałem w działaniach międzynarodowych organizacji turystycznych.

Artykuł 9

Strony utworzą grupę roboczą do spraw współpracy w dziedzinie turystyki, działającą w ramach Polsko-Mołdawskiej Komisji do spraw Współpracy Gospodarczej, której zadaniem będzie zapewnienie należytego wykonania postanowień niniejszej Umowy oraz rozwiązywanie problemów, które mogą powstać w toku jej realizacji.

Artykuł 10

Wszelkie rozbieżności dotyczące wykonania postanowień niniejszej Umowy będą rozstrzygane polubownie przez Strony w drodze dwustronnych negocjacji albo konsultacji.

Artykuł 11

Strony, za wzajemną zgodą, mogą zmienić niniejszą Umowę poprzez odrębne protokoły, które będą stanowić jej integralną część i wejdą w życie zgodnie z postanowieniami Artykułu 12 niniejszej Umowy.

Artykuł 12

1.    Umowa wejdzie w życie pierwszego dnia miesiąca następującego po dniu otrzymania drogą dyplomatyczną noty późniejszej, w której Strony poinformują się wzajemnie o spełnieniu wewnętrznych wymogów prawnych niezbędnych do jej wejścia w życie.

2.    Umowa niniejsza zawarta jest na okres pięciu lat. Ulega ona automatycznemu przedłużeniu na dalsze okresy pięcioletnie, jeżeli żadna ze Stron nie wypowie jej w drodze notyfikacji, najpóźniej na sześć miesięcy przed upływem danego okresu.

3.    Wypowiedzenie Umowy nie będzie miało wpływu na przedsięwzięcia podjęte i realizowane zgodnie z Umową w czasie jej obowiązywania, aż do czasu ich zakończenia.

dwóch jednobrzmiących egzemplarzach, każdy w językach polskim, rumuńskim i angielskim, przy czym wszystkie teksty posiadają jednakową moc.

W razie rozbieżności przy interpretacji postanowień Umowy, tekst w języku angielskim będzie uważany za rozstrzygający.

Guvemul Republicii Polone §i Guvemul Republicii Moldova, denumite in continuare "Parli",

Recunoscand necesitatea de a stabili un cadru legał pentru cooperarea in domeniul turismului;

Dorind sa promoveze in continuare relapile de prietenie dintre cetalenii Republicii Polone ęi cetalenii Republicii Moldova;

Conętientizand importan^a turismului pentru dezvoltarea relapilor economice ęi culturale, precum $i o mai buna injelegere a viepi, istoriei ęi patrimoniului cultural ale ambelor popoare;

Au convenit dupa cum urmeaza:

Articolul 1

Parple vor incuraja cooperarea in domeniul turismului, bazandu-se pe principiile, egalita^ii §i a beneficiilor reciproce, in conformitate cu legislapa na^ionala in vigoare in ambele State ale Parli lor, precum §i de prevederile prezentului Acord.

Articolul 2

Parple vor sprijini inilierea §i dezvoltarea cooperarii intre companiile din domeniul turismului, tur-operatorii §i organizaliile poloneze si moldovene§ti ce activeaza in domeniul turismului.

Articolul 3

Parole vor incuraja:

1) Schimbul de informapi §i materiale promoponale;

2) Participarea la targuri turistice, seminare, expozipi §i conferinle, precum §i schimbul programelor de evenimente turistice organizate pe teritoriul Parplor;

3)    Organizarea vizitelor de studiu pentru reprezentanpi administrapei, massmedia §i tur-operatorilor. Tururile vor familiariza participanpi cu potenpalul turistic §i cultural al Republicii Polone si Republicii Moldova;

4)    Elaborarea proiectelor comune in domeniul turismului in scopul principal de a atrage fonduri ale UE pentru dezvoltarea turismului;

5)    Organizarea altor evenimente turistice de promovare.

Articolul 4

Parple vor sprijini schimbul de informapi cu privire la:

1)    Actele juridice care regłementeaza activitatile turistice;

2)    Statisticile in turism;

3)    Condipile de investipi in sectorul turismului.

Articolul 5

Parple vor promova schimbul de informapi §i de experli, precum §i organizarea de instruiri pentru personalul din sectorul turismului in domeniile de interes ale Parplor.

Articolul 6

Parple vor promova investipile in sectorul turismului.

Articolul 7

Fiecare Parte va sprijini infiinlarea centrelor de informare turistica pe teritoriul statului celeilalte Parp, in conformitate cu legislapa naponala respectiva din ambele state.

Articolul 8

Parple vor face schimb de informapi §i experien|a ce rezulta din implicarea lor in activitaple organizapilor intemaponale de turism.

Articolul 9

Parole vor institui un grup de lucru responsabil de cooperarea in domeniul turismului, care i§i va desfaęura activitatea pe langa Comisia polono-moldoveneasca pentru Cooperare Economica, sarcina caruia va fi asigurarea implementarii corespunzatoare a prevederilor Acordului, §i identificarea solufiilor pentru orice probleme care pot aparea in cursul executarii acestuia.

Articolul 10

Orice litigiu privind implementarea prevederilor prezentului Acord va fi solutionat de catre parti pe cale amiabila, prin consultari sau negocieri bilaterale.

Articolul 11

Partile, de comun acord, pot amenda prezentul Acord, prin protocoale aditionale, care vor fi parte integranta a acestuia si vor intra in vigoare in conformitate cu prevederile Articolului 12 al Acordului.

Articolul 12

1.    Acordul intra in vigoare in prima zi a lunii urmatoare de la data receptionarii ultimei notificari in scris, prin canale diplomatice, prin care Parfile se informeaza reciproc cu privire la finalizarea procedurilor inteme necesare intrarii in yigoare.

2.    Prezentul Acord se incheie pe un termen de cinci ani. Acordul se prelungeste in mod automat pentru urmatoarele perioade de cinci ani, cu exceptia cazului in care una dintre Parji va notifica cealalta parte in scris despre intentia de a-l denunta cu cel putin §ase luni inainte de data expirarii acestuia.

3.    Denuntarea prezentului Acord nu va afecta proiectele deja realizate sau cele in curs de realizare, in conformitate cu Acordul in yigoare.

In caz de divergente in interpretarea prevederilor prezentulni Acord, textul in limba engleza va prevala.

Agreement

between the Government of the Republic of Poland and the Government of the Republic of Moldova on cooperation in the field of tourism

The Govemment of the Republic of Poland and the Govemment of the Republic of Moldova, hereinafter referred to as “the Parties”,

-Recognizing the need to establish a legał ffamework for cooperation in the field of tourism;

-Wishing to further promote ffiendly relations between the people of the Republic of Poland and the Republic of Moldova;

-Conscious of the importance of tourism for the development of economic and cultural relations, as well as the better understanding of life, history and cultural heritage of both nations;

Have agreed as fołlows:

Article 1

The Parties shall encourage cooperation in the field of tourism, based on the principles of eąuality and mutual benefits, in accordance with the national legislation in force in both States of the Parties, and provisions of this Agreement.

Article 2

The Parties shall support establishment and development of cooperation between the Polish and Moldavian tourism companies, touroperators and organizations active in the field of tourism.

Article 3

The Parties shall encourage:

1)    Exchange of information and promotional materials;

2)    participation in tourist fairs, seminars, exhibitions and conferences, as well as the exchange of schedules of tourism events organized in State territory of the Parties;

3) Organization of study tours for the representatives of tourism administration, media and tourism operators. The tours will familiarize the participants with tourism and cultural potential of the Republic of Poland and the Republic of Moldova;

4)    Elaboration of common projects in the domain of tourism with the main purpose to attract EU funds for tourism development;

5)    Organization of other promotional tourism events.

Article 4

The Parties shall support the exchange of information on:

1)    Legał acts regulating tourism activities;

2)    Tourism statistics;

3)    Investment conditions in the tourism sector.

Article 5

The Parties shall promote the exchange of information and of experts, as well as the organization of trainings for the tourism sector personnel within the scope of interest of the Parties.

Article 6

The Parties shall promote the investments in tourism sector.

Article 7

Each Party shall support the establishment of tourist information centres within the State territory of the other Party in accordance to the respective national legislation of both States.

Article 8

The Parties shall exchange inforraation and share their experience resulting from their involvement in the activities of international tourism organizations.

Article 9

The Parties shall establish a working group on cooperation in the field of tourism, operating under the Polish-Moldavian Commission for Economic Cooperation, whose task will be to ensure the proper implementation of the provisions of this Agreement and solve Solutions to any problems that may arise in the course of its execution.

Article 10

Any dispute regarding the implementation of the provisions of this Agreement shall be settled amicably by the Parties by means of bilateral consultations or negotiations.

Article 11

The Parties, by mutual consent, can amend this Agreement, through additional protocols, which shall constitute an integral part of it and shall enter into force as set out in the provisions of the Article 12 of this Agreement.

Article 12

1.    The Agreement shall enter into force on the first day of the next month from the datę of receipt of the last notification in written, through diplomatic channełs, by which the Parties notify each other on the completion of the intemal procedures necessary for the entry into force.

2.    The duration of this Agreement shall be five years. The Agreement shall be Automatically extended for subseąuent five year periods, unless one of the Parties will notify the other Party in written on the intention to terminate it not later than six months prior to its termination datę.

3.    The termination of this Agreement shall not affect any of the projects that have already been undertaken or the ones that are ongoing, pursuant to the Agreement in force.

In case of any differences in the interpretation of the provisions of this Agreement, the English text shall prevail.
